1. Acceptance

By using TeachShield, you agree to these Terms. If you do not agree, do not use the service.

2. Service Description

TeachShield is an AI-powered teacher productivity platform that provides automated grading, lesson planning, parent communication tools, and classroom management features. The service is provided by Obsidian Clad Labs LLC.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account.

5. AI-Generated Content

Grading feedback, lesson plans, and other AI-generated content are provided as suggestions and tools to assist educators. Teachers retain full responsibility for reviewing and approving all AI outputs before use. TeachShield is not a substitute for professional educational judgment.

6. Subscriptions & Billing

Paid plans are billed monthly through Stripe. You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial months. Free tier usage is subject to monthly limits.

7. Intellectual Property

You retain ownership of all content you submit. TeachShield retains ownership of the platform, AI models, and generated outputs. You are granted a license to use generated content for educational purposes.

8. Limitation of Liability

TeachShield is provided "as is" without warranties. We are not liable for any damages arising from use of the service, including but not limited to inaccurate grading, missed deadlines, or service interruptions. Our total liability is limited to the amount you paid in the preceding 12 months.

9. Termination

We may suspend or terminate accounts that violate these Terms. You may delete your account at any time. Upon deletion, we will remove your data within 30 days.

10. FERPA Compliance

TeachShield complies with the Family Educational Rights and Privacy Act (FERPA). When we process student education records on behalf of a school or district, we act as a school official with a legitimate educational interest under FERPA. We use student education records solely to provide and improve the services as directed by the educational institution. We do not use student education records for targeted advertising or any purpose other than providing the contracted educational service. Schools and districts retain full control and ownership of student education records at all times.

11. COPPA Compliance

TeachShield complies with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information directly from children under 13 without verifiable parental consent. TeachShield is designed to be used by teachers and educators, not directly by students. When student work is submitted through the platform by a teacher, the teacher's school or district is responsible for obtaining any necessary parental consents. If we become aware that we have inadvertently collected personal information from a child under 13 without appropriate consent, we will promptly delete that information. If you believe a child under 13 has provided us with personal information, please contact us immediately at support@teachshield.app.

12. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.
